Enclosed is your permit and the forms necessary for submitting information to comply with conditions of the permit as authorized by the Governing Board of the St. Johns River Water Management District on November 10, 1908. All compliance information must be submitted to the District's Palatka office, P. 0. Box 1429, Palatka, Florida 32178-1429.

Permit issuance does not relieve you from the responsibility of obtaining permits from any federal, state, and/or local agencies asserting concurrent jurisdiction for this work. 

The enclosed permit will expire on December 8, 2018.

In the event you sell your property, the permit will be transferred to the new owner if we are notified by you within thirty days of the recording of the sale. Please assist us in this matter so as to maintain a valid permit for the new property owner.

The permit enclosed is a legal document and should be kept with your other important documents. Please read the permit carefully since you are responsible for compliance with any provisos which are a part of this permit. Proviso compliance is a legal requirement and your assistance in this matter will be greatly appreciated.

According to chapter 40C-2.401 and section 6.4 of the Consumptive Water Use Handbook, a permanent tag will be issued by the District for well identification. This tag is prominently displayed at the site of withdrawal by permanently affixing the tag to the pump, headgate, valve, or other withdrawal facility. Failure to display a well tag shall constitute violation of a permit condition and may, if willful, be grounds for revocation of the, permit. Please refer to your copy of 40C-2 if you need further clarification.

You will find enclosed a copy of the map submitted with your applications with each well's location and number identified. When placing the tag on the well, refer to this map to ensure proper well identification.

CONDITIONS FOR ISSUANCE OF PERMIT UNDER 50242

DEPARTMENT OF ENVIRONMENTAL PROTECTION

DATED December 8, 1998

1. District authorized staff, upon proper identification, will have permission to enter, inspect and observe permitted and related facilities in order to determine compliance with the approved plans, specifications and conditions of the permit.

2. Nothing in this permit should be construed to limit the authority of the St. Johns River Water Management District to declare a water shortage and issue orders pursuant to Section 373.175, Florida Statutes, or to formulate a plan for implementation during periods of water shortage, pursuant Section 373.246, Florida Statutes. In the event a water shortage, as declared by the District Governing Board, the permittee must adhere reductions in water withdrawals as specified by the District.

3. Legal uses of water existing at the time of permit application may not be significantly adversely impacted by the consumptive use. If unanticipated significantly adverse impacts occur, the District shall revoke the permit in whole or in part to curtail or abate the adverse impacts, unless the impacts can be mitigated by the permittee.

4. Off-site land uses existing at the time of permit application may not be significantly adversely impacted as a result of the consumptive use. If unanticipated significantly adverse impacts occur, the District shall revoke the permit in whole or in part to curtail or abate the adverse impacts, unless the impacts can be mitigated by the permittee.

5. The District must be notified in writing, within 30 days of any sale, conveyance, or other transfer of a well or facility from which the permitted consumptive use is made or, within 30 days of any transfer of ownership or control of the real property at which the permitted consumptive use is located. All transfers of ownership or transfers of permits are subject to the provisions of section 40C-1.512 F.A,C.

6. All submittals made to demonstrate compliance with this permit must include CUP number 50242 plainly labeled on the submittal.

7. This permit will expire 20 years from the date of issuance.

8. The Maximum daily withdrawals for dewatering must not exceed 350 cubic feet per second, This allegation for dewatering is in addition to the normal discharge from the reservoir that is made to maintain reservoir operating levels. 

9. The maximum annual withdrawals for dewatering must not exceed 50,000 acre feet. This allocation for dewatering is in addition to the normal discharge from the reservoir that is made to maintain reservoir operating levels and is based on lowering of the water level in the reservoir from 18 ft msl to 11 ft msl.

10. The permittee is authorized by this permit to drawdown Rodman Reservoir for the purposes of aquatic weed control and fishery management to enhance the ecological quality of the reservoir. The drawdowns authorized by this permit may, only be conducted for the 6 1/2 month period between October 1st and April 15th of the succeeding year. Each of these drawdowns shall be concluded and the water level in the reservoir returned to the normal pool elevation of 18 feet msl by April 15th. In determining the schedule for drawdowns, the permittee shall consult with the Bureau of Fishery Management of the Florida Game and Freshwater Fish Commission. At least 30 days before commencing any drawdown authorized herein, the permittee shall provide written notice to the District and shall conduct a public meeting in Palatka, Florida, in order to inform the public of the intended drawdown.

11. This permit does not authorize the permanent dewatering of Rodman Reservoir associated with the restoration of the Oklawaha River,

12. Discharges must not cause or contribute to a violation of water quality standards. The permittee must select, implement and operate all erosion and sediment control measures required to retain sediment in uplands or areas that do not have standing or flowing water in order to prevent violations of water quality standards.

13. Permittee shall monitor withdrawals on a daily basis and report these daily withdrawals twice a year to the District on form EN-50.

14. Nothing contained herein relieves the permittee from timely complying with laws of, and obtaining any necessary approvals from, other federal state or local governments.

15. This permit authorizes no more than seven drawdowns during the 20 year permit duration.
